Before working with a Tyler Texas area real estate broker/agent, you should know that the duties of a broker/agent depend on WHOM the broker/agent represents.
A broker/agent who lists property for sale or lease is the Seller's
agent.
A broker/agent who acts as a subagent represents
the seller in cooperation with the listing broker.
A broker/agent who acts as a buyer's agent represents
the buyer.
A broker/agent is obligated by law to treat you honestly.
If you are relocating to the Tyler area and ask us for information
on homes to purchase, we will represent you, the buyer. We will become
your agent and agree to represent you in a friendly, honest, courteous
and professional manner. It will be necessary to have a written buyer
representation agreement to protect both you and us. This agreement
will clearly establish the broker's/agent's obligations and your obligations.
If you have a home to sell in the Tyler area and you choose THE
CARROLL TEAM to list your property, we would then become
the seller's agent by entering into a written agreement with you.
A listing broker/agent can assist a buyer but does not represent the buyer
and will place the interests of the seller first.
In some cases, a broker/agent may be asked to be an intermediary between
the seller and buyer. The broker/agent must then get a written consent
from each party to act as an intermediary. The consent must state
who will pay the broker, and set forth the broker's obligations as
an intermediary. The broker/agent must then treat each party honestly
and comply with rules set forth in the TEXAS Real Estate License Act.
WHAT ABOUT NEW HOMES?
THE CARROLL TEAM definitely includes new homes and
subdivisions in our showings of homes throughout any area you are
planning to relocate to. Builders do cooperate with realtors in the
Tyler area as we help sell a great percentage of their product. It
is best to have a Realtor represent you when considering a newly built
home, one that will be designed to your specifications or a builders
spec home.
If you have any questions at all regarding the duties and responsibilities
of the broker/agent, these questions should be answered and resolved
before you proceed with any agreement.
